Yes — this denial is patient-appealable. If the service was emergency care, federal law prohibits higher out-of-network cost-sharing for emergencies regardless of network status — argue those federal protections apply. If non-emergency, argue there was no in-network provider reasonably available, or that you were directed to the out-of-network provider by the plan.
